Collection timelines
How long does it take to collect a past-due account?
It depends on the document and on the debtor's response. Many accounts are resolved out of court with a formal demand and a written settlement. If a lawsuit is needed, the executory action on a pagaré is usually the most direct route because it allows a demand for payment and attachment from the outset (Commerce Code arts. 1391 section IV and 1392). We do not promise timelines or results: timing depends on the court and on the debtor's defense.
How long do we have to sue?
As a rule, a pagaré prescribes three years after its maturity (LGTOC art. 165). Other commercial debts have different periods, so the account should be reviewed before more time passes.
Costs
How are fees charged?
Every proposal is made in writing after reviewing the portfolio or matter: amount, documents, number of accounts and the state where the debtor is located. We do not publish rates because every portfolio is different.
What expenses besides fees may arise?
Depending on the case: service of process, court formalities, certifications, registry filings and correspondent expenses in other states. They are disclosed in advance in the proposal.
How we work
What happens after we send the portfolio?
We review documents and guarantees, classify the accounts and send a proposal with a strategy per account: formal demand, settlement or lawsuit.
How do you report progress?
One responsible lawyer per matter and periodic email reports with the status of each account and the actions taken.
