Short answer
SNZ Legal Group represents companies in commercial lawsuits: collection of receivables, breach of supply, distribution, contract-manufacturing and service agreements, negotiable instruments, and defence when the company is sued. We litigate from Guadalajara and, with our correspondent network, in other states. Every matter starts with a document review and a written route.
Matters we handle
- Judicial collection of invoices, promissory notes and cheques from customers and distributors.
- Breach of supply, distribution, contract-manufacturing and service agreements.
- Defence of the company when a customer, supplier or partner sues it.
- Precautionary measures, such as retention of assets, when there is a risk that the debtor will hide assets.
- Enforcement of judgments and court-approved settlements.
Procedural routes
The Código de Comercio provides several routes. The executory proceeding applies when the claim is based on a document that carries enforcement, such as a final judgment, certain public instruments or negotiable instruments like promissory notes and cheques (CCom art. 1391). Disputes with no special procedure go to the ordinary commercial proceeding when appealable (CCom art. 1377), and the Code also provides the oral commercial proceeding. The route depends on the document, the amount and the claim; we choose it after reviewing the file.
How we report to your team
Legal, finance or credit teams receive an email report on each file: status, last court action, next step and what we need from the company. We give advance notice of court vacation periods and deliver a full copy of the file on request.
How we start
- You send the contract, invoices, instruments and correspondence.
- We review documents, deadlines and procedural route.
- We deliver a written route with risks and next steps.
- We file the claim or the answer and report every action.
